FDNY Rule 3 RCNY § 608-01, NYC Fire Code Section 608 & NYC Department of Buildings (DOB) OTCR Bulletin

NYC FDNY & DOB Residential Battery Storage Rules (3 RCNY 608-01): How to Permit ESS in New York

Why New York City (FDNY & NYC DOB) has the strictest residential solar battery regulations in the world: understanding 3 RCNY § 608-01, why indoor garage batteries are banned in the 5 boroughs, and how Westchester, Long Island (PSEG-LI), and Upstate NY differ.

Capacity / Threshold Rule
Indoor Residential 1–2 Family: Strict Prohibitions / Outdoor Only with FDNY Certificate of Approval (COA)
Required Clearance / Hardware Spec
Outdoor Installation Only in NYC (5–10 Foot Setbacks + FDNY OTCR Equipment Listing)

1. Code Compliance Rules, UL 9540A Exceptions & Battery Physics

CODE 1

Rule 1 — Inside the 5 Boroughs of NYC (Manhattan, Brooklyn, Queens, Bronx, Staten Island), Indoor Lithium-Ion Batteries Are Effectively Prohibited: Under FDNY Rule 3 RCNY § 608-01 and NYC Department of Buildings (DOB) Buildings Bulletin 2021-011, lithium-ion energy storage systems are restricted to OUTDOOR installations only for one- and two-family dwellings, and every specific battery model must hold an active NYC DOB Office of Technical Certification and Research (OTCR) and FDNY Certificate of Approval (COA)!

CODE 2

Rule 2 — The NYC Outdoor Setback Matrix (Property Lines, Windows & Combustible Walls): Because rowhouses and brownstones in Brooklyn, Queens, and the Bronx sit on tight 20-to-25-foot lots, meeting FDNY outdoor clearances (distance to lot lines, public sidewalks, operable windows, and non-masonry siding) requires careful PE site plan engineering and UL 9540A large-scale fire test mitigation.

CODE 3

Rule 3 — Why Westchester County, Long Island (Nassau/Suffolk) & Upstate NY Are MUCH Easier Than NYC: The moment you cross the NYC border into Westchester County (Con Edison), Nassau/Suffolk Counties on Long Island (PSEG Long Island), or Upstate New York, FDNY rules do NOT apply! Instead, the New York State Residential Code (NYSRC R328 / NFPA 855) governs, which freely permits up to 40 kWh inside garages/utility rooms and 80 kWh outdoors with standard 3-foot (or UL 9540A reduced) clearances!

CODE 4

Rule 4 — Maximizing NYSERDA + ConEd / PSEG-LI VPP Battery Incentives When Permitting in NY: For NY homeowners who pass local permitting, pairing an LFP battery with Con Edison’s Demand Response VPP or PSEG Long Island’s Battery Storage Rewards program (plus the 25% NY State Solar Tax Credit up to $5,000 and 30% Federal ITC) offsets up to 65% of the system cost.

NFPA 855 & Solar Fire Safety FAQ

Why is FDNY so strict about lithium-ion batteries in New York City?

Following hundreds of apartment fires caused by uncertified imported e-bike and scooter NMC batteries in high-density tenements, FDNY enacted sweeping restrictions across all lithium-ion chemistries—even though stationary UL 9540A LFP solar batteries use a completely different, non-volatile iron-phosphate chemistry.

Can I install a Tesla Powerwall 3, Enphase IQ Battery 5P, or FranklinWH in my garage in Long Island (Nassau/Suffolk) or Westchester?

Yes! In Nassau County, Suffolk County, Westchester County, Rockland County, and all of Upstate New York, garage and exterior-wall installations of UL 9540 / UL 9540A LFP batteries are approved every day under the New York State Residential Code.

Which VPP programs pay New York homeowners for discharging their batteries during summer heatwaves?

Both Con Edison (DLRP/CSRP) and PSEG Long Island (Battery Storage Rewards) pay $300 to $600+ per kW-year for summer peak shaving—see our New York VPP guides at /vpp-programs.
