FORMAL NOTICE OF SOLAR PRODUCTION GUARANTEE BREACH & DEMAND FOR REIMBURSEMENT / REPAIR
Date: 2026-11-05
To: Sunrun / Freedom Forever / Solar Installer — Warranty, Production Guarantee & Legal Compliance Department
Re: Solar Installation (8.8 kW DC System, Installed 2023 — Region: Northern & Central California (PG&E))

To Whom It May Concern:

I am writing to formally notify Sunrun / Freedom Forever / Solar Installer of a material breach of the Solar Production Guarantee and Express Workmanship/Performance Warranty governing my 8.8 kW DC residential solar photovoltaic system installed in 2023.

1. AUDIT OF CONTRACTUAL VS. ACTUAL KWH PRODUCTION (YEAR 4):
• Year-1 Contractually Guaranteed Annual Production: 13,200 kWh/year
• Degradation-Adjusted Year-4 Guarantee (0.5%/yr degradation): 13,003 kWh/year
• Weather-Normalized Contract Floor (-10% tolerance band): 11,703 kWh/year
• Actual Verified Metered Production (Last 12 Months): 7,950 kWh/year (61.1% of Guaranteed Output)
• Total Production Deficit vs. Degraded Guarantee: 5,053 kWh
• Actionable Contract Breach Deficit (Below 90% Floor): 3,753 kWh

2. FINANCIAL DAMAGES & REIMBURSEMENT OWED:
• Contractual Guarantee Cash Payout Owed (3,753 kWh × $0.16/kWh): $600
• Actual Retail Utility Replacement Electricity Loss (5,053 kWh × $0.42/kWh retail utility rate): $2,122/year
• Projected 25-Year Cumulative Economic Harm if Unrepaired: $94,579

3. MANDATORY DEMAND FOR REMEDY WITHIN 14 BUSINESS DAYS:
Pursuant to the express terms of our Solar Installation Agreement, the federal Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.), and state Unfair and Deceptive Acts and Practices (UDAP) statutes prohibiting deceptive energy yield representations, I demand that Sunrun / Freedom Forever / Solar Installer take the following actions within fourteen (14) business days:
  (a) Issue a production deficit reimbursement check or account credit in the amount of $600 (or full retail utility restitution of $2,122);
  (b) Dispatch a certified solar diagnostic technician at zero cost to inspect all inverters, microinverters/optimizers, DC string insulation resistance, and array hardware to restore output to 100% of rated capacity; and
  (c) Provide a complete module-level diagnostic report from the monitoring portal.

If this breach is not cured within 14 business days, I will file formal complaints with the State Attorney General Consumer Protection Division, the State Contractors License Board, the CFPB (and solar loan/lease servicer under the FTC Holder Rule, 16 C.F.R. Part 433, to withhold/offset loan payments for breach of contract), and pursue all statutory remedies.

Sincerely,
[Your Full Name]

The 3 Fine-Print Traps Inside Solar Production Guarantees (And How to Beat Them)

1. The 85%–90% “Tolerance Floor” Trick

Even when a proposal cover page screams “100% Production Guarantee!”, Section 4 of the fine-print addendum usually sets the payout trigger at 85% or 90% of expected cumulative kWh. Always demand repairs for any hardware failure (dead microinverters or optimizers) under your Workmanship/Equipment Warranty rather than waiting for the 90% production floor.

2. The 14¢/kWh Payout vs. 45¢/kWh Utility Rate Trap

Many national PPAs and solar loans reimburse production shortfalls at a hardcoded $0.12 to $0.18/kWh—even if PG&E, SCE, SDG&E, or Eversource charges you $0.42 to $0.64/kWh to buy that missing power! If the deficit is caused by unfixed inverter defects or deceptive shading models, demand full consequential utility restitution.

3. Invoking the FTC Holder Rule on Financed Systems

If your installer ignores your production breach claim or went bankrupt, remember that every dealer-originated solar loan (GoodLeap, Mosaic, Sunlight, Dividend) contains the mandatory FTC Holder Rule Notice (16 C.F.R. Part 433)—making the lender legally subject to all claims and defenses you have against the installer.
